1. About this Policy

This Consumer Privacy Policy explains how Giftagram Inc. and Giftagram USA, Inc. (together, "Giftagram," "we," "us," or "our") collect, use, disclose, retain, and otherwise process personal information in connection with our consumer-facing websites, ecommerce experiences, mobile applications, partner storefronts operated by Giftagram, personal gifting services, marketing activities, customer support, and related services (collectively, the "Consumer Services").

This Policy applies to visitors to giftagram.com and related Giftagram websites; individuals who browse, purchase, send, redeem, receive, or review gifts through our Consumer Services; users of the Giftagram retail mobile application; individuals who interact with Giftagram-operated Shopify storefronts or other ecommerce storefronts; and individuals who contact us, subscribe to communications, participate in promotions, or otherwise interact with Giftagram in a consumer context.

This Policy does not apply to personal information processed solely in connection with Giftagram's B2B corporate gifting platform, GiftCenter, or enterprise gifting workflows, except where a consumer-facing storefront, recipient experience, or ecommerce transaction is expressly covered by this Policy. Giftagram Inc. is a Canadian company. Giftagram USA, Inc. supports certain United States operations. Our public mailing address is 487 Adelaide St. W., Suite 203, Toronto, ON M5V 1T4, Canada.

To operate the Consumer Services, process orders and gifts, arrange delivery, provide support, prevent fraud, personalize and improve services, send transactional and marketing communications, and meet legal obligations.

 

Who we disclose it to
Service providers, ecommerce providers, Shopify and related storefront technologies, payment processors, fraud prevention providers, logistics and delivery providers, brand or merchant partners, marketing and analytics providers, professional advisors, authorities, and transaction parties.

 

Where it is processed
Primarily in Canada and the United States, and in other jurisdictions where our vendors operate.

Your choices
You may request access, correction, deletion, certain opt-outs, marketing unsubscribe, and other rights depending on your jurisdiction.

 

4. Personal Information We Collect

Depending on how you interact with the Consumer Services, we may collect the following categories of personal information.

Identifiers and contact information
Name, email address, phone number, billing address, shipping or delivery address, account login details, recipient details, and public or business contact information.

Order, gift, and transaction information
Products viewed or purchased, order details, payment-related details, gift links, redemption details, delivery details, returns, refunds, gift credits, and related support information.

Recipient and personalization information
Recipient names, emails, phone numbers, addresses, gift messages, thank-you notes, product selections, sizes, preferences, survey responses, reviews, and other user-generated content.

Age-restricted or preference information
Age or eligibility information where legally required for alcohol or age-restricted products; dietary preferences, clothing sizes, or similar information you choose to provide.

Technical and usage information
IP address, device identifiers, advertising identifiers, browser type, operating system, approximate location, pages viewed, referral URLs, session information, email engagement, shopping cart activity, and behavioral analytics.

Marketing and communications information
Subscription status, communication preferences, campaign responses, ad interactions, lead-source information, CRM records, and support communications.

Information from third parties
Information from gift senders, ecommerce platforms, payment and fraud providers, logistics providers, storefront sponsors, advertising and analytics providers, social media platforms, and other business partners.

5. Sources of Personal Information

We collect personal information directly from you, automatically through your use of the Consumer Services, from gift senders or recipients, from ecommerce and payment platforms, from Shopify and related storefront technologies, from fulfillment and logistics providers, from fraud prevention and analytics providers, from marketing platforms, from social media or advertising partners, and from business partners that sponsor or participate in a gifting experience.

6. How We Use Personal Information

We use personal information for purposes that are reasonable and appropriate in the context of our relationship with you, including to provide and improve the Consumer Services.

Service delivery

Provide, operate, maintain, and improve the Consumer Services; process purchases, gifts, payments, redemptions, returns, refunds, support requests, and deliveries.

Gifting workflows

Notify recipients, generate and manage gift links, support gift selection or acceptance, personalize gifting experiences, process gift notes and thank-you messages, and report gift status where appropriate.

Security and fraud prevention
Detect, investigate, and prevent fraud, abuse, unauthorized activity, security incidents, and violations of our terms.

Marketing and personalization
Send marketing communications where permitted, measure campaigns, personalize content or recommendations, conduct retargeting and advertising, and understand customer interests.

 

Analytics and improvement
Analyze usage, performance, engagement, service quality, product demand, and business trends; create de-identified, anonymized, or aggregated information.

 

Legal and business purposes
Comply with laws, maintain records, enforce terms, respond to lawful requests, protect rights, support financing or business transactions, and administer our business.

7. Gift Senders and Gift Recipients

If you send a gift, we collect and use the information needed to process the gift, notify the recipient, support redemption, and arrange fulfillment or delivery. Please only provide recipient information if you are authorized to do so.

If you receive a gift, we may receive your name, email address, phone number, gift link, or other recipient information from the sender or from a partner associated with the gifting experience. We may also collect information directly from you when you accept a gift, select an item, provide a delivery address, submit a thank-you note, contact support, complete a survey, or otherwise interact with the Consumer Services.

8. Shopify, Partner Storefronts, and Ecommerce Providers

Some storefronts are operated by Giftagram using Shopify or other third-party ecommerce technologies. When you use those storefronts, your personal information may be processed by Shopify, payment processors, fraud prevention providers, logistics providers, brand partners, and other service providers as needed to operate the storefront, process orders, detect fraud, deliver products, and provide customer support.

Where a storefront, promotion, or gift experience is sponsored by or associated with a third party, that third party may receive limited personal information needed for the transaction or fulfillment, such as order, delivery, redemption, or campaign information. Third parties may also have their own privacy notices that apply to their independent processing of personal information.

9. Alcohol, Age-Restricted Products, and Sensitive Preferences

From time to time, Giftagram may make available alcohol or other age-restricted products only in jurisdictions where permitted by law. Where required, we or our service providers may collect or verify information related to age, eligibility, identity, delivery restrictions, or recipient availability.

From time to time, we may also collect information such as dietary preferences, clothing sizes, product preferences, gift personalization details, or other information that you choose to provide. Please do not provide sensitive information unless it is necessary for the gift, order, support request, or preference you are submitting.

10. Cookies, Analytics, and Advertising Technologies

We and our service providers use cookies, pixels, SDKs, tags, local storage, and similar technologies to operate the Consumer Services, enable shopping cart and checkout functionality, remember preferences, understand usage, improve performance, prevent fraud, support customer service, measure campaigns, personalize content, and deliver or measure advertising.

 

These technologies may involve providers such as analytics tools, ecommerce platforms, CRM systems, advertising platforms, email platforms, and social media or advertising networks. Certain uses of these technologies may be considered targeted advertising, sharing, or sale under some U.S. state privacy laws even though Giftagram does not sell personal information for money.

11. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients where appropriate.

Service providers and vendors
Hosting, cloud infrastructure, ecommerce platforms, payment processors, fraud prevention, email delivery, CRM, customer support, analytics, marketing, accounting, legal, insurance, security, and similar providers.

Fulfillment and logistics partners
Warehouses, brands, merchants, couriers, delivery providers, and logistics partners that need information such as recipient name, address, phone number, and order details to deliver gifts or products.

 

Partner storefronts and sponsors
Brands, merchants, sponsors, or partners associated with a storefront, promotion, or gifting experience, where disclosure is needed to operate or report on the experience.

 

Professional advisors and business parties

Lawyers, accountants, auditors, insurers, banks, investors, financing sources, and parties involved in a merger, acquisition, financing, reorganization, or sale of assets.

 

Legal and safety recipients
Courts, regulators, government authorities, law enforcement, or other parties where required by law or where we believe disclosure is necessary to protect rights, safety, security, or the public.

12. Cross-Border Processing

Giftagram is based in Canada and operates in Canada and the United States. We and our service providers may process personal information in Canada, the United States, and other jurisdictions where our vendors operate. As a result, personal information may be subject to the laws of those jurisdictions and may be accessible to courts, law enforcement, regulators, or government authorities in accordance with applicable law.

13. Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Consumer Services, complete transactions, fulfill gifts and orders, support customer service, maintain business and financial records, comply with legal, tax, accounting, product safety, fraud prevention, and regulatory obligations, resolve disputes, enforce agreements, and protect our rights.

Retention periods vary based on the nature of the information and the context in which it was collected. We may retain de-identified, anonymized, or aggregated information for analytics, reporting, product improvement, benchmarking, and business purposes where it no longer reasonably identifies an individual.

14. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, loss, alteration, or destruction. These safeguards may include access controls, encryption where appropriate, logging, least-privilege permissions, vendor review, reputable cloud and ecommerce infrastructure, penetration testing, and incident response procedures.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

15. Your Privacy Rights and Choices

Depending on your jurisdiction and subject to applicable exceptions, you may have rights to request access to personal information, correction of inaccurate personal information, deletion of personal information, portability, withdrawal of consent, restriction or objection to certain processing, opt-out of marketing communications, and opt-out of certain targeted advertising, sale, or sharing activities.

If we process information on behalf of another organization, we may direct your request to that organization or work with that organization to respond.

16. U.S. State Privacy Disclosures

Residents of certain U.S. states may have additional privacy rights, including rights to know or access personal information, correct inaccuracies, delete personal information, obtain a copy of personal information, and opt out of targeted advertising, sale, or profiling where applicable.

Giftagram does not sell personal information for monetary consideration. However, some uses of cookies, pixels, advertising technologies, or similar tools may be considered a "sale," "sharing," or targeted advertising under certain U.S. state privacy laws. Where required, you may opt out by using the controls described in our Cookie Notice, enabling a recognized universal opt-out signal such as Global Privacy Control, or contacting legal@giftagram.com.

 

We will not discriminate against you for exercising privacy rights.

17. Marketing Communications

You may unsubscribe from promotional emails by using the unsubscribe link in the message or by contacting us. We may still send transactional or service-related messages, such as order confirmations, gift notifications, redemption messages, shipping updates, security notices, and support communications.

Commercial electronic messages sent to recipients in Canada are managed in accordance with Canada's Anti-Spam Legislation requirements, including consent, sender identification, and unsubscribe requirements, where applicable.

18. Children

The Consumer Services are not directed to children, and we do not knowingly collect personal information from children without appropriate authorization. If you believe a child has provided personal information to us, contact legal@giftagram.com so we can review and take appropriate steps.

19. Quebec and French-Language Requests

Giftagram may support Quebec residents and French-language requirements for specific clients, programs, or legally required contexts. Where applicable, we will provide appropriate notices, communications, or assistance consistent with applicable Quebec privacy and language requirements.

20. Changes to this Policy

We may update this Policy from time to time. When we do, we will post the updated version and update the "Last Updated" date. If changes are material, we may provide additional notice where appropriate.
